General Terms and Conditions of Edelglas susa Handels KG.

 

1. Scope

These General Terms and Conditions (GTC) apply to all contracts and other services of any kind and both written and telephone as well as online orders from Edelglas susa Handels KG. By placing your order, you accept these General Terms and Conditions and agree to them.

 

2. Order, delivery, conclusion of contract

Orders can only be accepted by persons with full legal capacity. Customers under the age of 18 require the signature of their legal representative. Edelglas susa Handels KG is entitled, in the event of your withdrawal from the contract, to demand the direct costs of the return; however, it reserves the right to exercise this right. Price advantage campaigns and customer discounts are only valid until revoked. Immediately after receiving your order, you will receive a formal order confirmation via email. This states that Edelglas susa Handels KG has received your order. A contract is only formed when Edelglas susa Handels KG accepts your order. This acceptance takes place within 30 days at the discretion of Edelglas susa Handels KG either by delivering the goods or by sending a written order confirmation. Notification of receipt of your order does not yet constitute acceptance of the order. Edelglas susa Handels KG is free not to accept online orders. The decision on this is at their own discretion. If Edelglas susa Handels KG does not carry out an order, it will immediately inform the customer of this fact by e-mail. Edelglas susa Handels KG assumes no responsibility in the event of delivery obstacles in the area of suppliers and producers. If delivery or compliance with an agreed delivery time becomes impossible due to circumstances for which Edelglas susa Handels KG is not responsible, Edelglas susa Handels KG's obligation to deliver expires. In such a case you will be informed immediately. Edelglas susa Handels KG is therefore entitled to withdraw from the contract if delivery obstacles arise that are not attributable to Edelglas susa Handels KG. Claims for damages are, to the extent permissible, excluded in this respect. If Edelglas susa Handels KG is late with a delivery despite setting a grace period of at least 14 days, you as the customer can declare that you withdraw from the contract. Edelglas susa Handels KG will charge you a shipping fee for each delivery. In individual cases, a bulky goods surcharge can also be charged, the amount of which is attached to the respective product. Even in the case of partial returns, the shipping costs will be charged in full. Bonuses are applied to the value of the goods, but not to the shipping costs. The order data is saved in the shop and can be viewed under "My Account". After submitting the order, an order confirmation will be sent by email to the email address you provided. Due to the color reproduction of the customer's computer, there may be color deviations between the colors displayed on the website and the real colors of the models. Edelglas susa Handels KG therefore does not guarantee that the colors displayed on the website match the actual colors of the models.

 

3. Payment, default of payment, retention of title

The purchase price is due for payment within 14 days of the invoice date. The goods remain the property of Edelglas susa Handels KG until you have paid in full. All prices include the applicable statutory value-added tax and plus shipping costs. Payment can be made by credit card (Visa, Mastercard), by immediate transfer, by open invoice or by prepayment, as previously determined by Edelglas susa Handels KG. If Edelglas susa Handels KG delivers the goods cash on delivery, Edelglas susa Handels KG reserves the right to charge an additional cash on delivery fee. If you are in default of acceptance, Edelglas susa Handels KG can either store the goods, taking into account a storage fee of 0.1% of the invoice amount per calendar day or part thereof, and insist on fulfillment of the contract, or withdraw from the contract after setting a reasonable grace period and resell the goods after withdrawal. In the event of withdrawal, you have to pay a lump-sum compensation of 25% of the invoice amount in addition to the storage costs. In the event of default in payment, Edelglas susa Handels KG is entitled, after setting a reasonable grace period, to withdraw from the contract and to demand the return of the delivered goods from the customer. In the event of a delay in payment, Edelglas susa Handels KG is also entitled to charge default interest of 12% pa and reminder fees (up to €5 for each reminder). A debt collection agency is then commissioned to collect the debt. You are obliged to reimburse the collection costs that result in particular from the ordinance of the Federal Ministry for Economic Affairs (Federal Law Gazette 141/1996 in the current version) on the maximum rates of the collection agencies.

4. Right of Withdrawal, Right of Withdrawal

Edelglas susa Handels KG grants you a 14-day right of withdrawal from the day of receipt of the goods until revoked if you are a consumer within the meaning of the KSchG and have placed an online order. Saturday does not count as a working day. The withdrawal does not have to contain a reason, to meet the deadline it is sufficient to send the goods to the return address given on the invoice. The goods must be properly packaged, unused and undamaged and returned to the address provided with the original invoice. Within Austria, items ready for shipment are returned at the risk and expense of Edelglas susa Handels KG. 5. Creditor Protection

You agree that Edelglas susa Handels KG is entitled to transmit your name, date of birth and address to a credit checker in the case of delivery on open account (payment by payment slip) in order to obtain information about your creditworthiness. Under certain conditions, Edelglas susa Handels KG reserves the right to present proof of income or Edelglas susa Handels KG reserves the right to deliver cash on delivery if the creditworthiness is insufficient. In the event of a delay in payment, we will transmit your name, date of birth, address and the outstanding balance to a debt collection agency

6. Privacy

You agree that the personal data collected in the event of a contract being concluded and provided by you to Edelglas susa Handels KG - your name, date of birth, address, telephone number and e-mail address - is stored and processed in our system and processed be used for the duration of contract processing. You agree that your personal data will be included in Edelglas susa Handels KG's customer file and processed in such a way that you can be informed about products, innovations and price campaigns by post, e-mail or SMS. Edelglas susa Handels KG strictly adheres to the Data Protection Act when storing and processing your data. You have the right to free information, correction, blocking and deletion of your stored data at any time. This right is only limited insofar as we can suspend the deletion to protect our claims. After receipt of your objection or revocation, your data will no longer be used and processed for marketing purposes or the further sending of advertising material will be stopped immediately and / or your data will not be passed on for marketing purposes. You have the possibility of an online objection here. Edelglas susa Handels KG assumes no liability for any misprints in the advertising material and data errors in the online shop that are due to slight negligence. Edelglas susa Handels KG provides links to other sites on the Internet on its website. 7. Miscellaneous

Vienna is the place of performance for all obligations resulting from the contract. The contract is subject to Austrian law to the exclusion of the UN Sales Convention. The place of jurisdiction is – as far as permissible – Vienna. The invalidity of an individual provision of this contract does not result in the invalidity of the entire contract. The remaining content of the contract remains unchanged. Should individual provisions of these terms and conditions or the contract concluded with the contractual partner be wholly or partially invalid, this does not affect the validity of the rest of the contract.
